No matter how compliant, responsible or ethical a company may actually be, the existence of a “smoking gun” email or memo can be devastating, and can often greatly undercut a company’s ability to defend itself. Sometimes these “hot docs” accurately reflect a widespread rotten corporate culture. But often they arise from inadvertence, sloppiness, poor judgment or an attempt at humor.

This webinar will present an overview of the dangers that often arise from these smoking guns, as well as how companies can reduce the likelihood of their creation.

Among other things, you’ll learn the answers to the following questions:
  • What makes a document a “smoking gun?”
  • Why are these documents so critical in litigation?
  • What are some examples of smoking guns in recent litigation, and how did the affect their cases?

About The Presenter
 
Peter C. Anderson is a Shareholder at the law firm of Beveridge & Diamond, PC, and leads the firm’s White-Collar Defense and Corporate Compliance Group. Pete is a former federal prosecutor, whose current practice involves both reactive defense, as well as proactive compliance counseling. Pete also obtained his CCEP from the Society of Corporate Compliance & Ethics (SCCE). He frequently speaks and writes on topics involving federal white collar enforcement and defense, as well as corporate risk assessments and “effective” compliance programs. Pete is a permanent member of the Fourth Circuit Judicial Conference, and is an adjunct professor at the Charlotte School of Law. Pete is also a graduate of Rutgers University (summa cum laude) and the University of Virginia School of Law. Following law school, Pete also served as the judicial law clerk to the Hon. Graham C. Mullen, U.S. District Court (W.D.N.C. – Charlotte, N.C.)
